The President is stepping outside his constitutional duties: the debate on restrictions to demonstrations

After a meeting with intelligence services held Thursday morning, the President of the Republic declared that in the coming days, only marches organized upon call by trade union organizations will be authorized. This position has sparked strong criticism among legal experts who have spoken to the press.

In an extremely serious tone, Emmanuel Macron expressed the desire to prevent new clashes and violence, following the recent unrest of Black Saturday. The Head of State affirmed that, should requests for demonstrations come from entities lacking alleged legitimacy, prefects will proceed with a ban to ensure a return to calm. However, according to several jurists, this interpretation exceeds presidential prerogatives. Paul Cassia, a law professor at Sorbonne University, emphasized that the President does not hold the roles of Minister of the Interior or Prefect and that his declaration falls outside his constitutional role. Serge Slama, an expert in public law, also warned that such an approach seriously endangers the freedom to demonstrate.

In France, the right to assemble is considered a fundamental right derived from the Declaration of the Rights of Man and of the Citizen. Current regulations provide that a demonstration must simply be declared to the competent authorities, without the need for prior authorization. Freedom must be the rule, while the ban must remain an exception linked exclusively to concrete risks to public order.

The controversy also concerns the possibility of discriminating against demonstrators based on their affiliation with trade unions. Jurists reiterate that it is not the President’s job to establish who has the right to take to the streets and that anyone can organize a demonstration. Meanwhile, restrictions are multiplying in several cities: in Lyon, every march has been banned for Saturday, while similar restrictions affect the department of Bouches-du-Rhône and part of Paris. In these cases, the final decision rests with administrative justice, which must evaluate each single episode independently of the President’s declarations.

French debt exceeds the critical threshold of five percent

In a context of already extremely tense bond markets, the recent social revolts have further aggravated the situation, causing French debt yields to skyrocket. The yield on ten-year government bonds surpassed the five percent threshold on Wednesday, a level not seen since July 2002. In parallel, the spread between French and German bonds, considered the safest in the eurozone, approached one hundred and sixty basis points, reaching the highs reached last October 2nd.

The signal coming from the markets is clear: France is generating strong concern among investors. The protests of the past weekend have fueled a fire already fed by high indebtedness, difficulties expected in the budget process, and increasing political instability in view of the upcoming presidential elections. According to Benjamin Schroeder, rate strategist at ING, the demonstrations highlight how no government will have the simple task of implementing necessary reforms and savings in the face of widespread resistance from the population.

Recent updates indicate that the spread between France and Germany has reached one hundred and seventy-four basis points. For the first time, the interest rate on French government bonds has surpassed that of American bonds. In this scenario, a downgrade of France’s rating by credit agencies now appears probable, as credit authorities consider the French political situation potentially ungovernable.

Editorial by Rachel – France’s grand leap into the void

I am reading my editorial for today.

Welcome to the great play of chaos. While headlines scream that France is sinking, it seems that the only thing truly flying very high is not the well-being of citizens, but the rate of government bonds. Surpassing the 5% threshold is not just a number on a graph for bored experts; it is the signal that the ship is taking on water and that the captain, in this case Macron, is trying to repair the leak by shouting orders against the wind.

But let’s talk about what is actually happening in the streets: the revolts. It seems that the oil poured on the fire is not just from fryers, but from political instability. Markets are nervous, investors are fleeing as if they had seen a ghost, and France finds itself in a paradoxical situation: a scorching debt and a government responding to protests with the threat of banning every non-union demonstration. But would that really calm the markets or just give more reason to take to the streets?

There is a certain irony in seeing France, historically the beating heart of Europe, today risking being labeled ungovernable by rating agencies. It is a blow to the heart of political credibility. We are facing a spiral where instability feeds debt and debt feeds instability. It is a vicious cycle with no end, unless one stops playing tough when reality is already teaching everyone a lesson in humility.

And while we wonder if judges will block Macron’s bans or if France will manage not to crash against the wall of its own insolvency, a doubt remains: how long can a system resist that tries to impose order with force while economic foundations are falling apart? Prestige politics is giving way to the politics of survival. And, as always, the bill always arrives when you least expect it.

Koan of the day

A monk asked the Master: “If a nation’s debt exceeds the limit of common sense, is it perhaps because the nation has accumulated too many promises and too few facts?”

The Master replied: “Debt is not made of promises, but of time that is consumed before being transformed into reality.”

Then the monk insisted: “If the streets are burning and the numbers are rising, can the fire truly consume the trust of those watching from above?”

The Master smiled and said: “The fire that burns the street is real, but the fire that burns trust is invisible; when the smoke covers the sun, even the wisest can no longer see where to place their foot.”

But let’s return to the news.

Race against time to fix critical PHP vulnerabilities

The frantic activity on Friday to correct two critical vulnerabilities in PHP, the widely used web scripting language, occurred when it was already too late to stop all attacks. The publication of solutions for these flaws forced administrators and security specialists into a race against time to identify and protect websites and applications, while hackers began decoding the fixes to learn how to exploit the defects. Some governments and other groups even decided to preemptively disconnect strategic websites to avoid being hit before applying the patches.

In addition to the identification of active attacks occurring on Wednesday, research published that same evening by Amazon Web Services indicates that at least one malicious actor had already begun attempting to exploit the bugs, collectively known as PHP2Shell, on October 17, four days before the public revelations. AWS analysts detected this attempt by monitoring the activity of one of their honeypots, which are intentionally vulnerable web servers used to study attack trends. The attack came from an IP address linked to a commercial anonymization network, such as a proxy network or a VPN.

CJ Moses, head of cybersecurity at AWS, wrote that, although the vulnerability was under embargo, the targeting of a honeypot from an anonymous IP suggests activity conducted by a malicious actor, although it is not clear how they obtained the information about the exploit before official disclosure. Elizabeth Barron, executive director of the PHP Foundation, told WIRED that the organization was not aware of the AWS research prior to publication and released no immediate comment, adding that, while the update is imperative, there are no successful attempts of remote code execution.

While the first trial exploits of PHP2Shell appeared publicly on Wednesday, some seem to have emerged hours before the official disclosure. In the preceding hours, AWS researchers reported multiple anonymized exploitation attempts through various providers, indicating the presence of several actors. Moses confirmed that PHP2Shell is now being widely exploited.

Although it is not clear how the October 17 attempt occurred, AWS emphasizes that these results highlight the need to evolve and accelerate coordinated vulnerability disclosure. Global access to AI tools actually allows for accelerating the analysis of flaws, enabling even less experienced actors to quickly develop new exploits. According to Moses, the time between the publication of a patch and the creation of a working exploit is shrinking drastically, as AI-assisted analysis makes it much cheaper and faster to transform a technical warning into an attack tool.

The chocolate shop of Brigitte Macron’s family in Amiens: the prefecture denies special treatment

Recent demonstrations that took place in Amiens on October 17 sparked a controversy related to the presence of numerous law enforcement vans in front of the chocolate shop belonging to Brigitte Macron’s family. Some videos shared on social media showed the presence of police mobile units right in front of the family shop, fueling controversy regarding the possibility of privileged protection. The police union Alliance expressed strong doubts, asking President Emmanuel Macron for explanations regarding the destination of such law enforcement and the disparity of treatment among citizens. The publication Le Canard Enchaîné also claimed that a company of mobile units had been sent specifically to monitor the shops of the First Lady’s brother in Amiens and at Le Touquet.

Nevertheless, the prefecture of the Somme intervened promptly to restore the reality of the facts. Through an official statement, the authorities categorically denied the accusation that the mobile units were dedicated to the protection of the Trogneux shop. The prefecture explained that the vehicles were positioned in a pedestrian area, in Place Gambetta and near the station, to facilitate interventions along the commercial axis. The reinforcement of law enforcement was determined by the urgency of protecting the entire city center following violent acts committed against law enforcement.

The family chocolate shop has been at the center of tensions in the past. During the Yellow Vests movement in 2018, Brigitte Macron’s nephew was the victim of threats and insults due to rumors about the ownership of the business. More recently, in May 2023, Jean-Alexandre Trogneux’s son was physically attacked in front of the shop, an episode that occurred following a television speech by President Macron.

Tensions in France and security measures for protests

The French government is preparing a security device in view of the new mobilizations expected for October 24. The goal is to avoid the chaos that characterized recent unrest, with a massive deployment of law enforcement and the intervention of the army through the Sentinelle plan for the protection of sensitive areas.

While social tension grows, concerns are also being recorded among merchants in various French cities who fear new unrest. In parallel, authorities are monitoring attempts by some international actors to instrumentalize social discontent to create divisions within the country.

Artificial intelligence between massive investments and security risks

The global technology sector is undergoing a phase of profound transformation driven by artificial intelligence. Companies like Meta are investing hundreds of billions of dollars to remain competitive, despite the impact on cash flows and financial market uncertainties.

Far from being a risk-free reality, the era of artificial intelligence presents new vulnerabilities. Recent analyses have highlighted how hackers are already using advanced models such as Claude and Grok to automate cyberattacks against banks, making it necessary to strengthen digital defenses worldwide.

Financial markets and global economic uncertainties

The world economy shows signs of instability. In the technology sector, shares of some large companies are undergoing sharp declines following massive investments in the artificial intelligence sector that do not yet guarantee certain returns. In the semiconductor sector, the situation of SK Hynix remains variable after news regarding stock listing plans.

Attention is also shifting to French sovereign debt, which is facing a critical phase with interest rates marking new levels of pressure. This scenario of uncertainty is also reflected in sovereign wealth funds, which are recording significant losses due to the volatility of bond markets.

Geopolitics and new dynamics in Latin America

Political attention is focused on Brazil, where presidential elections are shaping up to be extremely contested. The latest analyses indicate an almost perfect balance between the main candidates, making the challenge decisive for the superpower’s influence in South America.

At the same time, diplomatic tensions are observed related to the policies of Elon Musk, whose role in managing the Starlink network in Ukraine is at the center of an international political debate, with requests for direct intervention from global political leaders.

Crisis in Sudan and impact of natural disasters

The humanitarian situation in Sudan is becoming dramatic with reports of deliberate attacks against hospital structures by conflicting forces, a phenomenon that international organizations are evaluating as a potential war crime.

In Asia, nature is unleashing its force: a powerful typhoon is hitting several areas, causing flight disruptions and safety concerns in several countries. Meanwhile, a strong earthquake has struck Tibet, causing structural damage and casualties, requiring urgent intervention from local authorities.

Luxury economy and new consumption trends

The luxury sector is facing structural changes in consumption patterns. In China, a significant trend is observed among younger consumers who, in order to save money, are turning to the used market, abandoning traditional big brands.

At the same time, the cosmetics and personal care sector is suffering the impact of new health-related phenomena, which influence global sales of major brands in the sector, making the market increasingly difficult to predict.

Developments in the cybersecurity sector

Digital security has become an absolute priority after the discovery of serious critical flaws in the PHP language, which have alerted the main global web actors. The detected vulnerabilities require rapid interventions to prevent large-scale attacks.

Technology companies are responding with new protection strategies, but the threat remains constant. The speed at which threats evolve requires continuous updates of systems to protect not only personal data, but also global critical infrastructures.
